Terms of Service

Important: ParkNarc is an independent service. It is not affiliated with, sponsored by, endorsed by, licensed by, or in any way connected to any university, college, university system, or parking authority. This includes the University of California and its campuses, the California State University and its campuses (including the California Polytechnic institutions), the California Community Colleges and their districts, and the Norwegian University of Science and Technology (NTNU). No institution has reviewed, approved, or authorised ParkNarc, and none of them is responsible for it, for anything a user posts in it, or for any consequence of relying on it.

1. Who We Are

These Terms govern your use of the ParkNarc mobile application and related services (the “Service”). “ParkNarc,” “we,” “us,” or “our” refers to Noe Gutierrez, a sole proprietor operating the Service from California, United States, who is the data controller for the purposes of the GDPR and the Norwegian Personal Data Act. 2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and are legally able to agree to these Terms.

3. Accounts, University Selection, and User Identity

3.1 University Names, Marks, and Independence

ParkNarc refers to universities and colleges by name so that you can find the campus you are actually parking at. Those names, and any abbreviations of them, are used only to identify the place. They are used descriptively and nominatively, not as branding.

Lot names, lot numbers, and campus boundaries shown in the app come from public sources and from what users tell us. They are approximations for finding your way around, not an official map, and they may be wrong or out of date.

3.2 Campus Rules Are Yours to Follow

This is the most important section in these Terms for your own protection.

If you receive a citation, are towed, are booted, lose a permit, are disciplined, or suffer any other consequence connected to parking, that is between you and the institution or authority involved. ParkNarc is not a party to it and has no ability to contest, cancel, appeal, or influence it.

3.3 Enforcement Staff Are People

Reports in ParkNarc are about activity — that enforcement was seen in a lot at a time. They are not about individuals.

The app is built to make this the default: aggregate estimates are derived from report activity and are never a record of any individual officer or patrol. Content that breaks these rules may be removed and the account terminated, and we may report conduct that appears to threaten someone’s safety.

4. User Content, Conduct, and Safety

The Service allows users to submit community reports, messages, and other user-generated content. ParkNarc has zero tolerance for abusive, harmful, unlawful, or objectionable behavior.

By submitting content within the Service, you agree to comply with these Terms and acknowledge that violations may result in content removal or account suspension or termination.

You agree that you will not post, transmit, or share content that includes or promotes any of the following:

Violations of this section may result in immediate removal of content and suspension or permanent termination of your account.

5. Content Moderation, Filtering, Blocking, and Enforcement

ParkNarc actively works to maintain a safe environment for users.

6. No Guarantee of Outcomes

ParkNarc does not guarantee any enforcement action, ticket cancellation, safety outcome, university response, availability of parking, delivery of any alert, or accuracy of any price or report. The Service is informational and community-based only.

7. Location Features and Checking In

If you choose to use “Locate Me,” to find lots or gas stations near you, or to check in to a lot, the Service may collect precise GPS location only at the time you use that feature. See the Privacy Policy for details.

7.2 Where you parked

The “Vehicle location” pin that walks you back to your car is held on your device only. It is not visible to any other user, and is deleted when you check out, sign out, or delete the app.

The coordinate your phone sends when you check in is not retained. It is used to confirm you are near that lot and then discarded, so we hold no history of the positions you have parked at. What a check-in does record is the lot itself and how long you were there, as described in the Privacy Policy.

8. Notifications

The Service uses push notifications to tell you about enforcement and incident reports at lots you are checked in to or have turned notifications on for, and to alert you about a vehicle matching a plate — or a vehicle description — you registered.

Do not rely on notifications. ParkNarc does not guarantee that any notification will be generated, delivered, delivered in time, or seen. Delivery depends on your device, your operating system, your network, your notification settings, and third-party services outside our control — and on someone choosing to file a report at all. Your vehicle may be ticketed, booted, towed, or damaged whether or not you receive a notification.

9. Parking Estimates and Ticket Risk

The Service may show estimates built from reports other users have filed — for example how full a lot has recently been, what time it usually fills, and an estimate of ticket risk for the current or coming hour, sometimes shown as a percentage or as a word such as “High.”

These are estimates from community reports, not predictions of what will happen, and not information from any university, parking authority, or enforcement agency. They may be wrong, out of date, or based on very little data. A low estimate is not a statement that you will not be ticketed, and “not enough data” or “not watched yet” means we do not know — it does not mean a lot is safe.

You are responsible for parking legally. Read the posted signs and hold a valid permit where one is required. ParkNarc is not responsible for any citation, fine, fee, tow, boot, or other cost, whatever any estimate showed.

10. Your Vehicle and Vehicle Alerts

You may optionally tell us about your vehicle, either by registering a license plate or by saving its make, model and colour. Both are entirely optional and the Service works fully without either. Their only purpose is to let another user warn you about your own vehicle — for example, if it appears to be getting ticketed or towed.

Instead of, or as well as, a plate you may save your car's make, model and colour. The same rule applies as to a plate: register only a vehicle you own or are authorized to use.

10.3 No guarantee that an alert arrives

Do not rely on vehicle alerts. ParkNarc does not guarantee that an alert will be generated, delivered, delivered in time, or seen. An alert depends on the owner having registered that exact plate, having notifications enabled, and having a working connection — and on someone choosing to file a report at all. Your vehicle may be ticketed, booted, towed, or damaged whether or not you receive an alert, and ParkNarc is not responsible for any citation, fee, tow, loss, or damage.

The Service may show fuel prices for gas stations near a campus. These prices are submitted by users. They are not provided, verified, or endorsed by the stations, and no station is a party to these Terms.

12. Report Accuracy and Account Standing

Reports are only useful if they are true. To keep them trustworthy, the Service keeps a private record of how your reports have performed, and may label reports in the app as confirmed or unconfirmed.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT ANY REPORT, ALERT, PARKING AVAILABILITY ESTIMATE, TICKET RISK ESTIMATE, OCCUPANCY COUNT, OR FUEL PRICE SHOWN IN THE SERVICE IS ACCURATE, CURRENT, OR COMPLETE, OR THAT ANY NOTIFICATION WILL BE GENERATED, DELIVERED, DELIVERED IN TIME, OR SEEN.

WE ALSO MAKE NO WARRANTY, AND ACCEPT NO RESPONSIBILITY, THAT ANY LOT SHOWN IN THE SERVICE IS OPEN, EXISTS, IS AVAILABLE TO YOU, PERMITS YOUR VEHICLE, OR MAY LAWFULLY BE USED BY YOU; THAT ANY LOT NAME, NUMBER, OR BOUNDARY MATCHES WHAT THE INSTITUTION USES; OR THAT ANY CAMPUS RULE, PERMIT REQUIREMENT, PRICE, HOUR, OR RESTRICTION IS ACCURATELY REFLECTED. CAMPUS PARKING RULES CHANGE WITHOUT NOTICE AND ARE SET BY THE INSTITUTION, NOT BY US. ALWAYS FOLLOW POSTED SIGNAGE AND THE INSTITUTION’S OWN PUBLISHED RULES, WHICH CONTROL OVER ANYTHING SHOWN IN THE SERVICE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKNARC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REPUTATION ARISING FROM YOUR USE OF THE SERVICE.

15. Indemnification

You agree to indemnify and hold harmless ParkNarc from claims arising out of your use of the Service, your content, or your violation of these Terms. This includes, without limitation, any claim, demand, citation, fine, penalty, disciplinary action, or proceeding brought by or on behalf of a university, college, university system, parking authority, or law enforcement agency that arises out of how you used the Service, what you posted in it, or where and how you parked.

Nothing in this section requires you to indemnify us for our own wrongdoing, and it does not apply to the extent the law where you live does not permit it — see Section 16.1 and Section 17.

16. Arbitration Agreement; Class Action Waiver

PLEASE READ CAREFULLY: You agree that disputes will be resolved by binding individual arbitration, and you waive any right to participate in a class action or class arbitration. You also waive the right to a jury trial.

Arbitration will be administered under a commonly used arbitration provider’s rules and conducted in California unless the parties agree otherwise. This section applies to the maximum extent permitted by law.

16.1 If you live in the EEA, Norway, Switzerland or the UK

This section does not apply to you. Consumers in the European Economic Area, Norway, Switzerland and the United Kingdom cannot be required to arbitrate, cannot be required to bring a claim in a foreign country, and do not give up the right to bring or join a collective action.

You keep every right you have under your own consumer-protection law. You may bring a claim in the courts of the country where you live, and nothing in these Terms limits any right you have under mandatory local law. If any part of this section conflicts with that law, that law wins.

17. Governing Law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws rules, and the state and federal courts located in California have jurisdiction — except where Section 16.1 applies.

If you live in the EEA, Norway, Switzerland or the United Kingdom, this choice of law does not deprive you of the protection of the mandatory law of the country where you live. Where those protections conflict with California law, the law of your own country governs to the extent of the conflict.

18. Termination

You may stop using the Service at any time. You may request deletion of your account through the in-app delete account feature. Deleting your account also removes your registered license plate and releases it. We may suspend or terminate access, remove content, or restrict functionality for violations of these Terms, abusive behavior, safety risks, fraud, or legal compliance concerns.

19. Changes to These Terms

We may update these Terms from time to time. When we make a material change, we will update the Effective Date above and note it in the revision history below. Continued use of the Service after changes means you accept the updated Terms.
