Terms of Service

1. Who We Are

These Terms govern your use of the ParkNarc mobile application and related services (the “Service”). “ParkNarc,” “we,” “us,” or “our” refers to the Service operator located in California, United States. Contact: support@parknarc.com.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and are legally able to agree to these Terms.

3. Accounts, University Selection, and User Identity

• You may be required to create an account (Google Sign-In) to use certain features.
• You must select a university (currently CSUMB; additional universities may be added later). ParkNarc does not verify enrollment or affiliation. You are responsible for selecting the correct university.
• Usernames may be displayed to other users in certain areas of the Service. Internal identifiers may also exist for security, moderation, analytics, and legal compliance.
• You are responsible for activity conducted through your account and for keeping your account access secure.
• By creating an account, accessing the Service, or submitting content, you agree to comply with these Terms. Violations may result in content removal, feature restrictions, suspension, or permanent termination of your account.

4. User Content, Conduct, and Safety

The Service allows users to submit community reports, messages, and other user-generated content. ParkNarc has zero tolerance for abusive, harmful, unlawful, or objectionable behavior.

By submitting content within the Service, you agree to comply with these Terms and acknowledge that violations may result in content removal or account suspension or termination.

You agree that you will not post, transmit, or share content that includes or promotes any of the following:

• Harassment, bullying, threats, intimidation, or abusive conduct
• Hate speech, discriminatory content, or content targeting protected groups
• Obscene, sexually explicit, or otherwise offensive material
• False, misleading, defamatory, or invasive content
• Illegal activity or encouragement of illegal acts
• Spam, impersonation, fraud, or manipulation of other users
• Personal information about yourself or others that should not be shared publicly

• No photos/uploads are supported at this time.
• Incident reports may include limited vehicle descriptors (e.g., make and color) and, for hazards, a short description (up to ~50 characters). Do not include personal data.
• Users may delete their own content at any time, and such content will be removed from public view immediately or as soon as technically processed by the Service.
• Do not use the Service while driving. If you create or view reports, do so only when safe and permitted by law.

Violations of this section may result in immediate removal of content and suspension or permanent termination of your account.

5. Content Moderation, Filtering, Blocking, and Enforcement

ParkNarc actively works to maintain a safe environment for users.

• Users can report objectionable content and abusive activity through tools made available in the app and through our support contact information.
• Users have the ability to block other users within the app to prevent further interaction or visibility of their content, subject to the Service’s technical design and feature availability.
• We use automated and manual moderation systems, including content filtering measures, to detect, review, and limit potentially objectionable content and abusive behavior.
• We may monitor, review, remove, restrict, or disable content at our discretion, including for policy violations, user safety concerns, abuse, fraud, or legal compliance.
• We review reports and take appropriate action within 24 hours, including removal of offending content and restriction, suspension, or termination of offending accounts when appropriate.
• We reserve the right to take any action necessary to protect users and the integrity of the Service.

6. No Guarantee of Outcomes

ParkNarc does not guarantee any enforcement action, ticket cancellation, safety outcome, university response, or availability of parking. The Service is informational and community-based only.

7. Location Features

If you choose to use “Locate Me,” the Service may collect precise GPS location only at the time you press the button. See the Privacy Policy for details.

8. Ticket Reimbursement Sweepstakes / Raffle (18+)

Overview: ParkNarc may offer a monthly ticket reimbursement sweepstakes/raffle (the “Promotion”) to eligible users. Participation is free (no purchase required). Void where prohibited.

8.1 Eligibility

• Must be at least 18 years old.
• Must have an active account and comply with these Terms.
• Promotion is intended for users associated with the selected university community (currently CSUMB), though ParkNarc does not verify enrollment.

8.2 How Winners Are Selected

Winners are selected by random drawing among eligible participants, which may be based on engagement signals in the app (e.g., qualifying activity thresholds). Drawing occurs monthly.

8.3 Reimbursement Amount and Coverage Window

• Reimbursement is capped at $50 USD per winner.
• Only tickets with an amount under $50 USD are eligible for reimbursement.
• The reimbursement applies to a parking ticket received after the user is selected as a winner.
• Coverage window: eligible tickets must be received within 4 months after winner selection.
• No guarantee of reimbursement beyond these terms.

8.4 Verification, Fraud Prevention, and Taxes

• Winners may be required to verify identity and eligibility (including reasonable proof of ticket and identity) before reimbursement.
• We may deny reimbursement for suspected fraud, abuse, or policy violations.
• Winners are responsible for any taxes, reporting, or obligations related to receiving reimbursement.

8.5 Changes / Termination

ParkNarc reserves the right to modify or terminate the sweepstakes at any time, subject to applicable law. ParkNarc may also disqualify participants for violations, abuse, or fraud.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKNARC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REPUTATION ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless ParkNarc from claims arising out of your use of the Service, your content, or your violation of these Terms.

12. Arbitration Agreement; Class Action Waiver

PLEASE READ CAREFULLY: You agree that disputes will be resolved by binding individual arbitration, and you waive any right to participate in a class action or class arbitration. You also waive the right to a jury trial.

Arbitration will be administered under a commonly used arbitration provider’s rules and conducted in California unless the parties agree otherwise. This section applies to the maximum extent permitted by law.

13. Termination

You may stop using the Service at any time. You may request deletion of your account through the in-app delete account feature. We may suspend or terminate access, remove content, or restrict functionality for violations of these Terms, abusive behavior, safety risks, fraud, or legal compliance concerns.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
